Consent for calls and texts
The TCPA restricts automated calls and texts. In February 2024 the FCC ruled that AI-generated voices count as "artificial" under the TCPA (FCC). Keep consent records and honor opt-outs everywhere.
Fair lending
AI shouldn't decide who gets credit or on what terms without careful review. Creditors must give specific reasons for adverse action, and the CFPB has said that applies to complex algorithms too (CFPB Circular 2022-03).
Borrower data
Many non-bank lenders and brokers are covered by the FTC's Safeguards Rule, which requires an information security program. Any AI vendor that touches borrower data belongs in it.
Marketing and disclosures
Automated messages still need to follow advertising rules and include required disclosures. Have templates reviewed before they go live, and log what was sent.

Can AI text our leads without breaking the rules?
It can be done responsibly, but the rules are strict. Consent, opt-outs, quiet hours and disclosures have to be designed in, not bolted on. We build those checks into code and recommend a compliance review of your setup.
Will an AI assistant replace our loan officers?
No. It handles repetitive follow-through so loan officers spend more time advising borrowers. People take over conversations whenever they choose.
Do you only work with LoanWick customers?
